Terms of Service

1. Eligibility and younger users

FretGOAT is available worldwide. You must be legally able to enter this agreement, or use FretGOAT with permission from a parent or guardian who agrees to be responsible for your use.

If you are under 18, you may use FretGOAT only with permission from a parent or guardian. A parent or guardian should make any purchase for you and is responsible for reviewing these Terms with you.

2. The public-beta service

FretGOAT is a public beta. It is useful now, but we are still testing, correcting and refining it. Features may contain bugs, change during the beta or occasionally be unavailable.

The initial supported setup is the latest desktop version of Chrome on Windows 11, using a clean single-note electric guitar signal through an audio interface and an internet connection. Other browsers, operating systems and input setups may work, but are not currently supported.

FretGOAT detects the pitch you play. It does not determine which physical string or fret produced that pitch. Results depend on your equipment, signal, environment and playing, so detection may not always be accurate.

3. Accounts

You must provide accurate account information, keep your sign-in credentials secure and use only your own account. Tell us promptly if you suspect unauthorised access. You are responsible for activity on your account unless caused by our failure to use reasonable care.

Do not share, sell or transfer your account or paid entitlement. Contact us if you lose access to an account connected to a Founding Pass.

4. Your right to use FretGOAT

While you comply with these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable right to use FretGOAT for your own lawful learning and practice.

You must not misuse FretGOAT, interfere with its operation or security, access another person's account, automate access in a way that burdens the service, introduce malicious code, copy or commercially exploit protected content, or reverse engineer the service except where applicable law expressly permits it.

5. Permanent free tier

The permanent free tier does not require payment or a timed trial. It includes:

• Open Position Mastery

6. Founding Pass

The Founding Pass is a US$39 one-time purchase for the purchasing account. It is not a subscription and does not automatically renew. In addition to the permanent free tier, it includes:

• Broader Builder and Direct practice
• Core and Full Neck Mastery
• Recommended Practice

7. Purchases, Paddle and taxes

Paddle is the merchant of record for Founding Pass purchases. Paddle operates the checkout, accepts payment, calculates and collects applicable taxes, issues the transaction receipt, performs payment and fraud checks, and helps process transaction-level refunds and disputes. Paddle's buyer terms and privacy notice also apply to the transaction.

The offer is described in US dollars. The amount and currency Paddle presents at checkout, including applicable taxes, is the amount you authorise before completing the purchase. Cloud9.0 supplies and supports the FretGOAT service and applies the paid entitlement to the verified purchasing account after successful payment confirmation.

8. Refunds and consumer rights

You may request a full refund of the Founding Pass within 14 days after purchase by emailing guitar@fretgoat.com. This is our voluntary refund policy. We may ask for information needed to locate and verify the Paddle transaction, and Paddle will process an approved transaction refund.

This voluntary policy is additional to your mandatory consumer rights. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, remedy or other right that cannot lawfully be excluded, including rights under the Australian Consumer Law and mandatory laws in your country.

9. Ownership and feedback

We and our licensors own FretGOAT, including its software, visual design, text, exercises, brands and other protected material. These Terms do not transfer that ownership to you.

You keep ownership of material you send us. If you voluntarily provide an idea or suggestion about FretGOAT, you give us permission to use it to operate and improve the service without payment or an obligation to implement it. Do not send material you do not have the right to share.

10. Service changes and availability

Because FretGOAT is a beta, we may add, refine, replace or remove features and may perform maintenance. We will act reasonably and, where practicable, give notice of a material change or extended interruption.

We will not rely on this clause to avoid a mandatory legal obligation or arbitrarily remove the substance of the Founding Pass entitlement. If a material change affects paid access, any remedies available under our refund policy or applicable law remain available.

We do not promise that FretGOAT will always be available, uninterrupted or error-free, or that it will produce a particular learning or playing result.

11. Third-party services and links

FretGOAT relies on third-party services such as Supabase and Paddle and may link to other websites. Their services and content are governed by their own terms and privacy notices. We are responsible for choosing and integrating our providers with reasonable care, but we do not control independent third-party services.

12. Suspension, termination and account deletion

You may stop using FretGOAT at any time and may delete your account through the authenticated deletion process. Account deletion removes your learning history and is not reversible through the product.

We may restrict or suspend access where reasonably necessary to protect an account or the service, investigate fraud or misuse, comply with law, or respond to a material breach of these Terms. Where reasonably practicable, we will explain the reason and provide an opportunity to remedy a breach before permanent termination.

Ending access does not remove rights or obligations that arose earlier, including mandatory consumer rights, payment or refund records, intellectual-property rights and provisions intended to continue after termination.

13. Responsibility and non-excludable rights

You are responsible for using suitable equipment, following safe playing and volume practices, maintaining your own internet and device security, and deciding how FretGOAT fits into your learning.

To the extent permitted by law, we are not responsible for loss caused by your breach of these Terms, an unsupported setup, inaccurate information you provide, or an event outside our reasonable control. We do not exclude responsibility where it would be unlawful to do so. Our responsibility for any failure remains subject to all non-excludable consumer guarantees and remedies.

14. Changes to these Terms

We may update these Terms to reflect service, provider or legal changes. We will post the updated Terms and change the last-updated date. We will give reasonable additional notice before a change that materially affects your rights where practicable or required by law.

Changes apply prospectively. If you do not agree to updated Terms, you may stop using FretGOAT. A change does not remove rights or remedies that arose before it took effect.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction. This does not prevent you from relying on mandatory rights or bringing a claim in another court where the law of your country gives you that right.

If part of these Terms is unlawful or unenforceable, it will be read down or removed only to the extent necessary, and the remainder will continue to apply.
